Water Heaters in Cupertino: What's Different
Cupertino's Building Division publishes its own water heater handout and an instant-permit list, while two water companies and SVCE set the rest of the local picture.
Instant permits for gas tank swaps only
A licensed contractor can pull an instant permit for a standard gas tank of the same or lower BTU rating, not at an HOA property. Tankless and heat pump water heaters need a standard building permit.
Two inspections, one handout
The handout, revised June 2026, says every installation or replacement needs a plumbing permit and two inspections: the water heater inspection and the final building inspection.
Expansion tank on closed systems
Where a check valve, backflow preventer or other closed device keeps pressure from easing back into the main, the City requires a listed expansion tank, whatever type of water heater you have.
Hard groundwater in both systems
Cal Water's 2025 Los Altos Suburban report puts its groundwater at 305 ppm average hardness, and San Jose Water's report puts its groundwater at 288 ppm. Both blend it with Valley Water near 97 to 99 ppm.
SVCE heat pump water heater rebate
Cupertino is in Silicon Valley Clean Energy's area. Its Home Rebates cover heat pump water heaters of 40 gallons or more meeting NEEA Tier 3, approved before installation.
Zero-NOx gas water heaters from 2027
Air District Rule 9-6 sets a zero-NOx standard for home gas water heaters manufactured after January 1, 2027. The Board votes November 4, 2026 on moving that to January 1, 2028.
A Homeowner’s Guide to Water Heater Repair and Replacement in Cupertino
Instant or standard permit
Cupertino’s handout states it plainly: every water heater installation or replacement needs a plumbing permit, followed by a water heater inspection and a final building inspection. How fast the permit comes depends on the heater:
- Instant permit: licensed contractors only, through Accela Citizen Access. It covers a standard gas tank of the same or lower BTU rating, not tankless and not at an HOA property.
- Standard building permit: everything else, including every heat pump and tankless water heater.
Questions go to the Permit Center at (408) 777-3228 or permitcenter@cupertino.gov. We pull the permit for you as part of the job. See water heater repair and replacement.
What the City’s handout requires
The Building Division’s Water Heater Installation and Replacement handout (revised June 11, 2026) sets the minimum 2025 California Plumbing Code checks:
- Seismic bracing: straps in the upper and lower thirds, the lower at least 4 inches above the controls; other methods need the City’s approval.
- Expansion tank: required on a closed system, whatever type of heater, installed on the building side of the check valve or backflow preventer and sized to the maker’s instructions.
- Relief valve drain: full size, by gravity, unthreaded, pointing down, ending 6 inches to 2 feet above the ground, never into the pan, and easy to see.
- Venting: a Type B or L vent at least 5 feet above the highest draft hood, through roof flashing to a listed cap, and 3 feet above a forced-air inlet within 10 feet.
- Gas: a sediment trap after the shutoff and bonded aboveground gas piping.
- Insulation: domestic hot water piping insulated to the pipe’s diameter.
- Location: 18-inch burner height in garages unless flammable-vapor ignition resistant, barriers against cars, a drain pan where a leak could cause damage, and attic access of at least 22 by 30 inches with a platform, outlet and light.
Two water companies, both partly on groundwater
The City’s water page lists three systems: California Water Service in the northeast, San Jose Water in the southeast, and the City-owned system in the west, which has two wells and is run by San Jose Water under a lease extended to 2036. Their 2025 reports:
| Supplier | Groundwater hardness (avg., range) | Valley Water hardness (avg.) |
|---|---|---|
| Cal Water, Los Altos Suburban | 305 ppm (137–440) | 97 ppm |
| San Jose Water, incl. City system | 288 ppm (175–451) | 99 ppm |
Groundwater-heavy water leaves sediment in tanks and scale on tankless heat exchangers, so flushing and descaling matter more here. See tankless water heaters.
Gas water heaters and the Air District
Cupertino’s electrification codes address new buildings, and the City suspended enforcement of its all-electric chapter on May 15, 2024. For a replacement, the regional rule is the one to watch. Under the Bay Area Air District’s Rule 9-6:
- gas water heaters of 75,000 BTU/hr or less manufactured after January 1, 2027 must be zero-NOx; larger units, tankless included, follow on January 1, 2031;
- on November 4, 2026 the Board votes on moving those dates to 2028 and 2033 and adding exemption certificates;
- working heaters can stay, and propane units aren’t covered.
See the zero-NOx rules and gas water heaters.
Heat pump water heaters and SVCE
Cupertino is in Silicon Valley Clean Energy’s service area. Its Home Rebates pay toward a heat pump water heater that replaces gas or electric resistance in a home of up to four units. Conditions from SVCE’s April 2026 specifications: 40 gallons or more, NEEA Tier 3 or higher, a thermostatic mixing valve, proof of permitting, and no tankless models. Apply before installing; approved reservations hold up to 120 days, and SVCE asks emergency replacements to contact it. Because a heat pump unit needs a standard permit here, plan the reservation and permit together. See SVCE heat pump rebates and heat pump water heaters.

Water Heater Prices in Cupertino
Most repairs are quoted as a fixed price before we start, so you approve the cost before any work begins. These are typical prices for common jobs in our service area.
| Service | Typical price (USD) |
|---|---|
| Tank water heater | $1,200–$2,000+ |
| Gas water heater | $1,500–$4,500+ |
| Electric water heater | $1,600–$4,000+ |
| Tankless water heater | $1,800–$6,000+ |
| Heat pump water heater | $2,500–$6,000+ |
| Inspection feeWaived for service plan members | $59 |
Prices are installed, before any current special, and depend on access, materials and what we find.
In Cupertino, a like-for-like gas tank can go on an instant permit, but tankless and heat pump units need a standard building permit, which takes longer. Older installs often need updates to pass inspection: straps, an expansion tank on a closed system, a relief drain run to the right height outside, or a vent that ends at least 5 feet above the draft hood.
Get a free estimate →Antonio did an excellent job fixing the water heater room noise issue. He took the time to properly diagnose the root cause instead of just treating the symptoms, which I really appreciated.
He went through multiple steps to resolve it, including draining and cleaning the water heater and adding vibration pads between the water pipes and the wall to reduce the noise transmission.
He was professional, thorough, and clearly knows what he’s doing. Highly recommend Antonio if you’re dealing with similar issues.

Great, reliable, and timely service at a reasonable price. I shopped around quite a bit before landing on CPI. Their rates were competitive, they responded promptly, and their plumber fixed a few issues quickly and without much fuss. I’ll definitely be calling them again the next time we have issues!

We had a water service line leak. Danny the technician arrived on time and explained everything to us clearly. He is nice, knowledgeable and professional. He finished the job by himself perfectly and the area was left clean. We would definitely request this technician again when we contact CPI Service in the future.

Water Heater Service in Cupertino FAQs
Do I need a permit to replace a water heater in Cupertino?
Yes. The Building Division's handout says a plumbing permit is required for all water heater installations and replacements, with a water heater inspection and a final building inspection. A licensed contractor with an Accela Citizen Access account can get an instant permit for a standard gas tank of the same or lower BTU rating, not tankless and not at an HOA property. Heat pump and tankless water heaters need a standard building permit. The Permit Center answers at (408) 777-3228. See water heater repair and replacement.
What does Cupertino's inspector look for on a water heater?
The City's handout follows the 2025 California Plumbing Code: straps in the upper and lower thirds of the tank, the lower one at least 4 inches above the controls; an expansion tank on a closed system; a relief valve drain that runs full size by gravity, unthreaded and pointing down, ending 6 inches to 2 feet above the ground and never in the pan; a Type B vent that ends at least 5 feet above the draft hood; a sediment trap; insulated hot water piping; and bonding of the gas piping.
Can a water heater go in a garage, attic or closet in Cupertino?
Yes, with conditions from the City's handout. In a garage, burners and igniters sit at least 18 inches above the floor unless the heater is flammable-vapor ignition resistant, and it needs protection from cars. In an attic, the access opening must be at least 22 by 30 inches with a floored passageway, a 30-by-30-inch work platform, a receptacle and a light, and a pan with a drain where a leak could cause damage. In a bedroom or bathroom it must be direct vent or sit in a gasketed, self-closing closet with outdoor combustion air.
Is Cupertino's water hard on water heaters?
Often, yes. California Water Service serves the northeast of the city, and San Jose Water serves the southeast and runs the City-owned system in the west. Both blend local groundwater with Valley Water. Cal Water's 2025 report shows groundwater averaging 305 ppm hardness and Valley Water 97 ppm; San Jose Water's shows 288 ppm and 99 ppm. Flush a tank yearly and descale a tankless unit on schedule. See tankless water heaters.
Can I still replace a gas water heater with a gas one in Cupertino?
Today, yes, and a like-for-like gas tank is the one water heater job on the City's instant-permit list. Cupertino's electrification codes target new construction, and the City suspended its all-electric chapter on May 15, 2024. The Bay Area Air District's Rule 9-6 is the bigger change: gas water heaters of 75,000 BTU/hr or less manufactured after January 1, 2027 must be zero-NOx, unless the Board's November 4, 2026 vote moves the date. See the Bay Area zero-NOx rules.
Does SVCE offer a rebate for a heat pump water heater in Cupertino?
Yes. Silicon Valley Clean Energy, Cupertino's electricity provider, offers Home Rebates for a heat pump water heater replacing a gas or electric resistance unit in a home of up to four units. Its April 2026 specifications call for at least 40 gallons, NEEA Tier 3 or higher and a thermostatic mixing valve, with proof of permit; tankless units don't count. Apply before installation: an approved reservation lasts up to 120 days. See SVCE heat pump rebates.
How much does water heater repair and replacement cost in Cupertino?
Most jobs are quoted as a fixed price before we start, so you know the cost up front. Typical prices: tank water heater $1,200–$2,000+; gas water heater $1,500–$4,500+; electric water heater $1,600–$4,000+; tankless water heater $1,800–$6,000+; heat pump water heater $2,500–$6,000+. The inspection fee is $59, waived for service plan members.
